Terms of Use Policy (TUP) for Cowboy Classifieds

Cowboy Classifieds is a suite of online resources which includes (but is not limited to) classified ads, 3rd party billboard ads, business listings, community forums, informative content, and various other services, (referred to hereafter as "the Service") and which is subject to the following Terms of Use Policy ("TUP").

This TUP is effective November 1, 2008, and may change at any time.

By visiting and using Cowboy Classifieds you are agreeing to the following terms, which have been established to ensure that Cowboy Classifieds provides an ideal service for all who choose to use it. When using any specific service, you are also agreeing to abide by any applicable posted guidelines for all Cowboy Classifieds services.

Cowboy Classifieds reserves the right, at any time, to take whatever means possible to strictly enforce the TUP through moderation of user activities, active investigation, and legal prosecution, however we are not obligated to do so. Should you disagree with any part of the TUP or any future modifications, or become dissatisfied in any way with the Service, you have no other recourse than to immediately terminate use.

Use of Cowboy Classifieds

By using Cowboy Classifieds, you agree also to advertise or post in the appropriate category and area and promise not to undertake any of the following activities that we do not tolerate or accept.

You also agree not to post, email, distribute, or otherwise make available Content:

a) that is unlawful, harmful, threatening, abusive, harassing, defamatory, libelous, invasive of another's privacy, or harmful in any way;
b) that may be considered or contains pornography;
c) that is damaging, discriminatory, abusive, or is hateful toward an individual or group of individuals on the basis of gender, race, color, sexual orientation, ethnicity, spiritual beliefs, age, disability;
d) that contains software viruses or computer code, files or programs which are designed to interrupt or destroy the functionality of any computer software or hardware or telecommunications equipment, or which is otherwise harmful to Cowboy Classifieds users or their property;
e) which is or contains spam, chain letters, or pyramid schemes;
f) that includes personal or identifying information about another person without that person's explicit consent;
g) that is false, misleading, deceitful, or misinformative;
h) that infringes any patent, trademark, trade secret, copyright or other legal rights of any party, or Content to which you do not have any legal rights;
i) that includes links to commercial services or web sites, except those indicated or allowed in "Services";
j) that employs misleading personal identifiers in order to disguise the origin of Content transmitted through the Service.

Additionally, you agree not to:

k) break any laws;
l) infringe on the rights of any 3rd party;
m) impose unreasonable loads on our infrastructure or interfere with the ongoing operation of Cowboy Classifieds;
n) copy, modify, or distribute any other person's content;
o) collect information about others, including email addresses, without their consent, for any purposes other than those specified through their posts or ads;
p) attempt to bypass Cowboy Classifieds security systems or engage in any activity that disrupts, diminishes the quality of, interferes with the performance of, or impairs the functionality of, the Cowboy Classifieds website;
q) contact anyone who has asked not to be contacted, or make unsolicited contact with anyone for any commercial purpose;
r) use automated means to harvest data from the Service;
s) post non-local or otherwise irrelevant Content;
t) repeatedly post the same or similar Content or otherwise impose an unreasonable or disproportionately large load on our infrastructure.

Please use our Abuse Reporting System to inform us about any undesirable activities, problems or concerns you encounter, or offensive content so that together we can enjoy the benefits of this site.

We reserve the right to limit or terminate our services, remove content and take any other technical and legal steps necessary to deny a user to access of Cowboy Classifieds if we have reason the believe that they are creating problems or acting inconsistently with our policies. Whether or not we undertake any of the aforementioned actions, we still do not accept any liability for unauthorized or unlawful content, the use of Cowboy Classifieds by users or advertisers.

When you give us content, you are granting us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sub-licensable right to exercise the copyright, publicity, and database rights to that content. (Note: These rights are required in order for us to host and display your content.)

Liability

Cowboy Classifieds is not responsible, nor liable for the activities of its advertisers or users. We also do not guarantee or ensure the accuracy of postings or user communications or the quality, safety, or legality of the goods or services offered, or to provide continuous or secure access to our services.

We expressly disclaim all warranties, representations and conditions, express or implied, including those of quality, merchantability, merchantable quality, durability, fitness for a particular purpose and those arising by statute. We are not liable for any loss, whether of money (including profit), goodwill, or reputation, or any special, indirect, or consequential damages arising out of your use of Cowboy Classifieds. Some jurisdictions do not allow the disclaimer of warranties or exclusion of damages, so such disclaimers and exclusions may not apply. However, if we are found to be liable, our liability to you or any third party is limited to the greater of: a) the total fees you have paid to us in the 12 months prior to the action, and (b) $100 Canadian.

Use of Personal Information

By using Cowboy Classifieds, you agree to the collection, transfer, storage and use of your personal information by (Cowboy Classifieds /TN13615430). You also agree to receive systems communications from us, unless you opt out of receiving any such information.

General

This TUP constitutes the entirety of the agreement between Cowboy Classifieds (TN13615430 Inc.) and the user, and supercedes any such prior agreement. This agreement is subject to the laws of Canada. Non-enforcement of any specific provision does not constitute a waiver of any future rights to enforcement. Any legal notices must be sent to us at:
